In accordance with the DMCA, Gloucester Hardware has adopted the policy below regarding copyright infringement. We reserve the right to (1) remove or disable access to material that we believe in good faith to be copyrighted material that has been copied and distributed unlawfully by any of our advertisers, affiliates, content providers, members, or users, and (2) terminate service for repeat offenders.

Please note that your use of Gloucester Hardware services is always subject to our Terms of Service, including this Copyright Dispute Policy. Any capitalized terms used in this Policy and not otherwise defined have the meanings given to them in the Terms of Service.

Procedure for Reporting Copyright Infringement

If you believe that any material or content available on or through our Services infringes your copyright, or the copyright of someone you are authorized to act on behalf of, please send a notice of claimed infringement to our Designated Agent with the following information:

  • A physical or electronic signature of a person authorized to act on behalf of the owner of the copyright allegedly infringed;
  • Identification of the copyrighted work claimed to have been infringed;
  • Identification of the material that is claimed to be infringing, including information reasonably sufficient to allow us to locate the material;
  • Your contact information, including your full name, address, telephone number, and email address, if available;
  • A statement that you have a good faith belief that the use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law;
  • A statement, made under penalty of perjury, that the information in the notice is accurate and that you are authorized to act on behalf of the copyright owner.

What Happens When a Proper Infringement Notice Is Received

Upon receipt of a valid notice of claimed copyright infringement, Gloucester Hardware reserves the right to:

  • Remove or disable access to the allegedly infringing material;
  • Notify the content provider who is accused of infringement that we have removed or disabled access to the material; and
  • Terminate the content provider’s access to the Services if they are a repeat offender.

Procedure for Submitting a Counter-Notice

If you believe that material you posted was removed or disabled by mistake or misidentification, you may send a counter-notice to our Designated Agent containing the following information:

  • Your physical or electronic signature;
  • Identification of the material that has been removed or to which access has been disabled, and the location where the material appeared before it was removed or disabled;
  • A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification;
  • Your name, address, telephone number, and email address, if available;
  • A statement that you consent to the jurisdiction of the appropriate court and that you will accept service of process from the person who provided the original infringement notice or their agent.

If we receive a valid counter-notice, Gloucester Hardware may send a copy of it to the original complaining party and may restore the removed material or cease disabling access to it within 10 to 14 business days, unless the copyright owner files a court action seeking to prevent restoration of the material.
